1. Introduction

Acceptance of Terms

Welcome to NOC ("we," "us," "our," or "the App"). By downloading, accessing, or using the NOC mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and NOC. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the App after any changes constitutes acceptance of the revised Terms.

2. Eligibility

2.1 Age Requirement

You must be at least 13 years of age to use the App. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the App under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

2.2 Campus Affiliation

The App is designed for students affiliated with educational institutions. By registering, you represent that you are currently enrolled in or affiliated with the campus you select during registration.

2.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3. Account Registration and Security

3.1 Account Creation

• You must register for an account using a valid email address.
• You will receive a One-Time Password (OTP) for verification.
• You must create a secure password for your account.
• You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibility

• You are solely responsible for all activities that occur under your account.
• You must immediately notify us of any unauthorized use of your account.
• We are not liable for any loss or damage arising from your failure to maintain account security.

3.3 One Account Per User

You may only maintain one account. Creating multiple accounts may result in suspension or termination of all accounts.

4. User Conduct and Content

4.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable local, state, national, or international law.
• Harass, abuse, threaten, or intimidate other users.
• Post or transmit any content that is illegal, harmful, threatening, abusive, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity.
• Post or transmit any unsolicited or unauthorized advertising, promotional materials, spam, or any other form of solicitation.
• Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.
• Interfere with or disrupt the App or servers or networks connected to the App.
• Attempt to gain unauthorized access to any portion of the App or any other systems or networks.
• Use any automated means (including bots, scrapers, or spiders) to access the App.
• Collect or store personal data about other users without their express permission.

4.2 User-Generated Content

The App allows you to create, post, and share content including:

• Posts with text and images
• Comments on posts and events
• Event creation and management
• Profile information and images
• Club-related content

By posting content, you grant NOC a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the App and our business operations.

4.3 Content Ownership and Responsibility

• You retain all ownership rights to your content.
• You are solely responsible for all content you post.
• You represent and warrant that you own or have the necessary rights to post your content.
• You represent that your content does not violate any third-party rights, including intellectual property rights.

4.4 Content Standards

• Must not contain any material which is defamatory, obscene, offensive, hateful, or inflammatory.
• Must not promote sexually explicit material, violence, or discrimination.
• Must not infringe any copyright, trademark, or other intellectual property rights.
• Must not be likely to deceive any person or be used to impersonate any person.
• Must not promote any illegal activity or commercial activities without our prior written consent.
• Must be relevant to the campus community.

5. Content Moderation and Reporting

5.1 Reporting Violations

We provide tools for users to report inappropriate content. You can:

• Report posts that violate these Terms.
• Block posts from appearing in your feed.
• View and manage your blocked content.

5.2 Our Right to Remove Content

We reserve the right, but are not obligated, to:

• Monitor, review, and moderate user content.
• Remove or disable access to any content that violates these Terms.
• Remove content that we deem inappropriate, offensive, or harmful.
• Take action against users who violate these Terms.

5.3 No Obligation to Monitor

We are not obligated to monitor user content and assume no responsibility for monitoring the App for inappropriate content or conduct.

6. Club and Event Features

6.1 Club Leadership

• Certain users may be granted leadership roles (President, Vice President, Treasurer, Club Leader).
• Club leaders have additional responsibilities including content moderation and membership management.
• Leadership roles come with the authority to approve or reject join requests.
• Abuse of leadership privileges may result in removal of leadership status or account termination.

6.2 Event Management

• Club leaders can create and manage events.
• Event attendance may require approval from event organizers.
• Event information may be added to users' device calendars with their permission.
• Users must obtain necessary permissions before hosting in-person events.

6.3 Join Requests

• Users may request to join clubs.
• Club leaders have discretion to approve or reject requests.
• Decisions should be made fairly and without discrimination.

7. Notifications

7.1 Push Notifications

By using the App, you consent to receive push notifications regarding:

• Activity on your posts and events
• Club updates and announcements
• Event reminders
• System notifications

7.2 Managing Notifications

You can manage notification preferences through:

• App settings (notification toggle)
• Device operating system settings

Disabling notifications will not affect your ability to use core app features.

8. Privacy and Data Collection

8.1 Data Collection

Our collection, use, and sharing of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

8.2 User Data

By using the App, you acknowledge and agree that we collect:

• Personal information (name, email, gender, date of birth)
• Academic information (campus, degree, course, batch)
• Profile images and user-generated content
• Usage data and activity information
• Device information and Firebase Cloud Messaging tokens

9. Intellectual Property Rights

9.1 App Ownership

The App, including all content, features, functionality, software, and design, is owned by NOC and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes, subject to these Terms.

9.3 Restrictions

You may not:

• Copy, modify, or create derivative works of the App.
• Reverse engineer, decompile, or disassemble the App.
• Remove or alter any copyright, trademark, or other proprietary notices.
• Use the App for any commercial purpose without our written permission.
• Frame or mirror any part of the App without our prior written authorization.

9.4 Trademarks

NOC name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of NOC. You may not use such marks without our prior written permission.

10. Third-Party Services

10.1 Firebase Services

The App uses Firebase Cloud Messaging for push notifications. Your use of Firebase services is subject to Google's Terms of Service and Privacy Policy.

10.2 Third-Party Components

The App incorporates various open-source and third-party components. Use of these components is subject to their respective licenses.

10.3 Calendar Integration

The App may integrate with your device calendar. By using calendar features, you grant permission to add events to your calendar.

10.4 No Endorsement

We do not endorse or assume responsibility for any third-party services, applications, or content.

11. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, including but not limited to:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT.

YOUR USE OF THE APP IS AT YOUR SOLE RISK. We do not warrant that:

• The App will meet your requirements.
• The App will be available at any particular time or location.
• Any defects or errors will be corrected.
• The App is free of viruses or other harmful components.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOC SHALL NOT BE LIABLE FOR:

12.1 Indirect Damages

ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to:

• Loss of profits, data, use, goodwill, or other intangible losses.
• Damages resulting from your access to or inability to access the App.
• Damages resulting from any conduct or content of any third party on the App.
• Unauthorized access, use, or alteration of your transmissions or content.

12.2 Direct Damages

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12.3 Basis of the Bargain

THE LIMITATIONS OF THIS SECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT, OR OTHERWISE, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

13. Indemnification

You agree to defend, indemnify, and hold harmless NOC, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms.
• Your violation of any rights of another party.
• Your violation of any applicable laws or regulations.
• Your content or any content posted using your account.
• Your use or misuse of the App.
• Your breach of any representations or warranties contained in these Terms.

14. Account Termination

14.1 Termination by You

You may delete your account at any time through the App settings. Upon deletion:

• Removal of your profile information.
• Deletion of your personal data (subject to our data retention policies).
• Loss of access to all App features.

14.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the App, without notice, for violations, fraudulent/abusive/illegal activity, extended inactivity, or other reasons at our sole discretion.

14.3 Effect of Termination

• Your right to use the App will immediately cease.
• We may delete your account and all associated data.
• You remain liable for all obligations incurred prior to termination.
• Sections that by their nature should survive termination shall survive.

14.4 Content After Termination

Content you have posted may remain visible to other users even after account deletion; we will make reasonable efforts to remove your identifiable information.

15. Geographic Restrictions

The App is controlled and operated from our facilities. We make no representations that the App is appropriate or available for use in all locations. Access to the App from territories where its contents are illegal or restricted is prohibited.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

16.2 Dispute Resolution

• Good faith negotiation between the parties.

We may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights.

17. Apple App Store Terms (iOS Users)

17.1 Acknowledgment

• These Terms are between you and NOC, not Apple.
• Apple has no obligation to provide maintenance or support for the App.
• Apple is not responsible for addressing any claims relating to the App.
• Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the App infringes intellectual property rights.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

17.2 Usage Rules

Your use of the App must comply with the App Store Terms of Service and the Usage Rules set forth in the Apple Media Services Terms and Conditions.

17.3 Minimum Requirements

The App requires a compatible iOS device and may require minimum software versions to function properly.

18. Google Play Terms

18.1 Google Acknowledgment

• These Terms are between you and NOC, not Google.
• Google has no obligation or liability to you with respect to the App.
• Your use of the App must comply with Google Play's Terms of Service.

18.2 Google Play Policies

The App complies with Google Play's User Data, Device/Network Abuse, Malicious Behavior, and Content policies.

19. Device Permissions

19.1 Required Permissions

• Internet Access
• Network State
• Camera
• Photo Library
• Notifications
• Calendar (with your consent)

19.2 Permission Management

You can manage permissions through your device settings. Denying certain permissions may limit app functionality.

20. Updates and Modifications

20.1 App Updates

We may release updates to the App from time to time. Updates may include new features, bug fixes, or security enhancements. You are responsible for updating the App to continue using it.

20.2 Terms Updates

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the new Terms, updating the "Last Updated" date, and sending a notification if required by law. Continued use constitutes acceptance.

21. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.

22. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision shall not constitute a waiver.

23. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us in the App, constitute the entire agreement between you and NOC regarding the App and supersede all prior agreements.

24. Assignment

You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. We may assign these Terms without restriction.

25. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

27. Educational Purpose Disclaimer

27.1 Institutional Independence

NOC is an independent platform and is not officially endorsed, sponsored, or administered by any educational institution, college, or university mentioned in the App.

27.2 Event Liability

Events organized through the App are created by users and club leaders. NOC is not responsible for:

• The safety, legality, or appropriateness of events.
• Any injuries, damages, or losses incurred at events.
• Ensuring compliance with institutional policies.

Users attending events do so at their own risk.

28. User Disputes

We are not responsible for disputes between users. If you have a dispute with another user, you release NOC from any claims, demands, and damages of every kind arising out of or in any way connected with such disputes.

29. California Residents

If you are a California resident, you may have these Terms mailed to you electronically by sending a letter to the address listed in the Contact Information section with your electronic mail address and a request for these Terms.

Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.

30. Children's Privacy

We do not knowingly collect personal information from children under 13 without parental consent. If you believe we have inadvertently collected information from a child under 13, please contact us immediately so we can delete such information.
